This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioners are seeking pre-arrest bail in connection with Konark P.S. Case No. 88 of 2022 corresponding to G.R. Case No. 251 of 2022, pending on the file of the learned JMFC., Konark for commission of offence under Sections 341/ 323/324/ 326/ 427/379/307/34 of the I.P.C.

Considering the submissions of the learned counsel for the parties and taking into account that the overt act is attributed to Petitioner No.1 (Kailash Swain), this Court is not inclined to entertain the anticipatory bail application in respect of petitioner Nos.1, and the same accordingly stands rejected. 5.

So far as petitioner Nos.2, 3 and 4 are concerned, taking into account the nature of the allegations, this Court directs that on surrendering within three weeks hence and moving for bail,

petitioner Nos.2, 3 and 4 shall be released on bail by the learned court in seision over the matter on such terms and conditions as deemed just and proper.

Accordingly, the ABLAPL is disposed of.
