Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with T.R. Case No.47/12 of 2017-18 arising out of Burla P.S. Case No. 161 of 2017 on the file of learned 1st Additional District and Sessions Judge, Sambalpur registered for the alleged commission of offence under Sections 20(b)(ii)(C) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 1st Additional District and Sessions Judge, Sambalpur by order dated 22.02.2021, the present BLAPL has been filed 5.

Taking into account that the petitioner is in custody since 19.05.2017 and trial stated to have not commenced and keeping in view the judgment of the Apex Court in the case of Hussainara Khatoon and others Vrs. State of Bihar, reported in (1980) 1 SCC 81, this

Court directs that the petitioner shall be released on bail. The terms shall be fixed by the learned court in seisin over the matter. 06.

Accordingly, the BLAPL stands disposed of.
