1. This matter is taken up by Hybrid mode.

2. This application under Section 482 of Cr.P.C. has been filed by the Petitioner for quashment of the order dated 10.01.2011 passed by the learned S.D.J.M., Jharsuguda in G.R. Case No.1360 of 2009 issuing N.B.W.(A) against him.

3. It appears that for non-compliance of the order dated 18.01.2017, this Criminal Misc. Case was dismissed. Thereafter, CRLMA No.187 of 2021 was filed for restoration of the CRLMC and vide order dated 22.12.2021, this CRLMC was restored to file.

4. The G.R. Case is of the year 2009. None appears for the Petitioner, when the matter was called. Therefore, this Court dismisses this CRLMC as the Petitioner is a recalcitrant litigant.

5. However, it is open to the Petitioner to surrender and move an application for bail in the aforesaid case before the court in seisin over the matter. If such a prayer is made, the court in seisin over the matter shall do the needful to decide such application of the Petitioner in accordance with law, taking note of the fact that the Petitioner has been indicted in an offence under Section 304(A) IPC, expeditiously.
