1. The operative direction in the impugned order of the learned Single Judge is that the application made by Respondent No.1Institution with late fee charges should be considered if it is filed by 16th April, 2012.

2. The above order of the learned Single Judge was stayed by this Court while admitting this appeal on 4th July, 2012. That stay order has continued ever since.

3. Despite service of notice, none has appeared on behalf of Respondent No.1 or even filed an affidavit. No attempt has been made to vacate the interim order passed by this Court. It appears

that Respondent No.1 is perhaps not interested in pursuing the matter any further.

4. Consequently, the impugned order of the Single Judge is set aside and the writ appeal is allowed.
