This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No. 25 of 2020, arising out of Bhanjanagar P.S. Case No. 17 of 2020 pending in the Court of learned SDJM, Bhanjanagar for the alleged commission of offence punishable under Sections- 395 of the I.P.C, and Sections 25(1-B)(a), 27 of the Arms Act.

Learned counsel for the petitioners submits that the basis of implication of the petitioners is the statement of the co-accused and that the petitioners have no criminal proclivity.

Taking into account the submission and considering the recitals in the F.I.R., this Court directs that on surrendering within three weeks hence and moving for bail, the petitioners shall be released on bail. The learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper. 6.
While enlarging the petitioners on bail, the learned Court below shall verify the criminal antecedent of the petitioners. If it comes to the fore that the petitioners have any criminal antecedents, this order shall stand recalled automatically without any further reference to this Court.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
