1. For the reasons stated, the delay in filing the writ appeal is hereby condoned.
2. The application for condonation of delay is allowed. W.A. No.461 of 2017
3. In the last over five years, the Appellant has, despite there being no stay of the impugned order, not implemented it.
4. Learned counsel appearing for the Appellant informs the Court that the Respondents, who benefitted by the impugned order, has also not filed any contempt petition seeking its implementation.
5. Consequently, the Court sees no reason why it should interfere. In the event that the Respondent seeks to implement the impugned order of the learned Single Judge, it will be open to the Appellant to revive the present writ appeal. It is disposed of as such.
