CORAM:
JUSTICE BISWANATH RATH
ORDER
02.05.2022 1.
Heard learned counsel appearing for the parties. Order No.
2.
Through the document at Annexure-1, Mr.Nayak, learned counsel appearing for the petitioner claiming the petitioner to be the son of Nrusingha Charan Nayak, the patadar of Annexure-1 referring to Plot No.1819 and further the plea in the writ petition in paragraphs- 6, 7 and 9, it is alleged that without any right, title and interest and without following process of law even the opposite parties are undertaking an exercise of eviction and demolition involving the petitioner's own property. There is no quarrel by the State counsel that there cannot be any eviction or demolition without following due process of law. 3.
This Court taking serious note of this but however without entering into the controversy at this stage, in disposal of the writ petition observes in the event there is no proceeding initiated involving the petitioner either for vacation of the land or eviction otherwise, there should not be any eviction or demolition without following due process of law.
4.
With this observation ,the writ petition stands disposed of. (Biswanath Rath) Judge Sks
