This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Adava P.S. Case No. 93 of 2021 corresponding to G.R. Case No. 95 of 2021, pending on the file of the learned Special Judge, Gajapati for commission of offence under Sections 20(b)(ii)C/25/29 of the NDPS Act. 4.

The petitioner is apprehending arrest in a case under the NDPS Act, in which seizure to the tune of 316 Kg. 600 gms. of Ganja. 5.

Considering the bar under Section 37 of the NDPS Act, this Court is not inclined to exercise its jurisdiction under Section 438 Cr.P.C. 6.

Accordingly, the ABLAPL is dismissed.

It shall be open to the petitioner to surrender and move for bail before the court below, which shall be considered on its own merit. V.Narasingh Dhal (Vacation Judge)
