This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State.

The present writ petition has been filed by the petitioner with a prayer for a direction to the Chairman, Central Board of Secondary Education (CBSE), Delhi for correction of the marks of the petitioner in AISSE Results 2020-2021.

It is submitted by learned counsel for the petitioner that the invalid marks prepared by the Opposite Parties, errors have been committed. Accordingly, the same has been sought for to be rectified by the School and the School Authority have already intimated the Chairman, CBSE seeking correction of the marks of the petitioner. The Opposite Party No.3-School has already written a letter to the Chairman, Central Board of Secondary Education (CBSE), Delhi for correction of marks of the petitioner. However, the School has not got
// 2 // any intimation from the Opposite Party No.2.

Mr. Pattnaik, learned counsel for the Chairman, Central Board of Secondary Education (CBSE), Delhi is not aware in such letter issued by the School authority to the Board. However, in the event in such letter is received, the same be dealt with in accordance with law and as per Rules and Regulation of the CBSE.

Considering the aforesaid submissions made by the parties, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.3 to supply a copy of the letter, which has been sent to the Chairman, Central Board of Secondary Education (CBSE), Delhi(Opposite Party No.2), the same be served on Mr. Pattanaik, learned counsel appearing for the Opposite Party No.2, who usually communicate to the authority, the Chairman, Central Board of Secondary Education (CBSE), Delhi(Opposite Party No.2) for taking a decision in the matter. In the event copy of such letter handed over to Mr. Pattanaik, learned counsel for the Opposite Party No.3 in Court today and therefore, the Chairman, Central Board of Secondary Education (CBSE), Delhi(Opposite Party No.2) shall consider the case of the petitioner as per Rules and Regulations of CBSE within a period of three week from today and shall do the needful as per law and communicated to the School (Opposite Party No.3) within two weeks thereafter.

With the aforesaid observation/direction, the writ petition stands disposed of.
Urgent certified copy of this order be granted on proper application.
