1. This writ petition has been filed at this stage when the Appellate Authority for Industrial & Financial Reconstruction (AAIFR) had by the impugned order dated 7th December, 2007dismissed an appeal filed by the present Petitioner for non-prosecution. Now there is no AAIFR and consequently, the present petition has been rendered infructuous.

2. Counsel for the Petitioner states that they may approach IPICOL for a settlement. It is clarified that it will be open to the Petitioner to approach any of the creditors for a settlement.

3. The writ petition is disposed of and the interim order stands vacated.
