Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.04.2022 in connection with Excise Station Patnagarh P.R. No. 09 of 202223 corresponding to 2(a)CC Case No.2 of 2022 pending in the Court of learned Special Judge-cum-Additional Sessions Judge, Patnagarh for the alleged commission of offence under Sections 21(a) of NDPS Act.

It is alleged that the petitioner was in possession of 42 numbers of Escuf Cough Syrup bottles while he was apprehended by the Excise Officials.

It is submitted that nothing was seized from the possession of the petitioner and that he is entangled in the case entirely on suspicion.

Considering the submissions as above, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the

matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.

BLAPL is accordingly disposed of.
