Heard Mr. P.C. Nayak, learned counsel for the petitioner. 3.

The petitioner has filed this writ petition seeking to quash Annexure-6 dated 24.07.2017 issued by opposite party no.6 terminating the contract agreement, and to issue direction to the opposite parties to make payment of the admitted bills so far it relates to the work executed by the petitioner in terms of the agreement.

In course of hearing, Mr. P.C. Nayak, learned counsel for the petitioner fairly states that the petitioner does not want to press the first prayer of the writ petition with regard to termination of contract. But so far as the claim with regard to the admitted bills is concerned, the petitioner may be permitted to move the authority by filing fresh representation and direction may be given to the authority to consider the same in accordance with law, to which Mr. P.P. Mohanty, learned Addl. Government Advocate has raised no objection.

As agreed by learned counsel for the parties, this writ petition stands disposed of with the direction that in case the petitioner files a fresh comprehensive representation, with regard to second relief for release of admitted bills, before the opposite

party authority within a period of fifteen days hence, the same shall be considered by the said authority by passing a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with certified copy of this order. Issue urgent certified copy as per rules.
