Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 02.06.2022 in connection with Bisamcuttack P.S. Case No.51 of 2022 corresponding to T.R. Case No.53 of 2022 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Gunupur for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

It is alleged that the petitioner along with two other persons were transporting contraband ganja weighing 23 Kg 500 grams in a car when they were apprehended by Police. The other occupant of the car, namely, Sushant Majhi has already been granted bail by this court as per order passed in BLAPL No. 3720 of 2022. The petitioner was the driver of the said vehicle.

Having regard to the above facts as also taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail
on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
