Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 13.03.2022 in connection with Rourkela P.S. Case No.126 of 2021 corresponding to G.R. Case No.1775 of 2021 pending in the Court of learned S.D.J.M., Panposh, Rourkela for the alleged commission of offence under Sections 302/201 of IPC. 4.

It is alleged that the petitioner in association with one Bhola committed the murder of the deceased. The petitioner has not been named in the FIR but was implicated in the case on the basis of the statement of the co-accused. The alleged weapon was also recovered from the possession of the coaccused. There is no other legally acceptable evidence prima facie against the petitioner.

Considering the submissions as above I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the

condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
