This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 7th June, 2012 passed by the learned Judge, Family, Court, Khurda in Crl.P. No.468 of 2010 wherein the petition for time filed on his behalf has been rejected and allow him to adduce his evidence.

Mr. S.K. Dash, learned counsel for the Petitioner submits that he has no instruction in the matter from his client. 4.
Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2012 and notice in this case is yet to be issued, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter. 5.
Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
