Mr. P. K. Mohanty, learned Additional Standing Counsel has filed an affidavit dated 6th December, 2022 of the Superintending Engineer, Sonepur (R&B) Division, Sonepur (the affidavit is placed on record), wherein it is stated that the order dated 16th July, 2019 passed by this Court in W.P.(C) No.11338 of 2019 stands complied with as the admissible amounts have been determined and a certificate of royalty refund stands issued in favour of the petitioner, which shall be duly honoured by the Tahasildar, Sonepur positively within two months from the date of the presentation of the same along with the application by the petitioner.

In view of the aforesaid projected stand on behalf of the Tahasildar, Sonepur releasing the amount within two months, counsel for the petitioner concedes that the present CONTC has become infructuous and accordingly, the same is dismissed as infructuous.
