Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The I.A. has been filed seeking modification of the condition imposed by this Court while granting bail to the petitioner of furnishing cash security of Rs.20,000/-.

It is submitted by learned counsel for the petitioner that because of severe financial constraints, the petitioner is unable to arrange the required money for the above purpose and therefore, despite being granted bail since more than a month back, he is still languishing in jail custody. As such, he has prayed for waiver of the condition of furnishing cash security.

Learned Addl. Standing counsel fairly submits that having regard to the submissions made, the Court may pass appropriate orders.

Considering the submissions as above, the I.A. is allowed. The order dated 31.05.2022 passed in ABLAPL No. 5034 of 2022 is
modified only to the extent that instead of cash security of Rs.20,000/-, the petitioner shall furnish cash security of Rs.5,000/- with all other conditions remaining intact.

The date of surrender of the petitioner before the Court below is extended to two weeks.

I.A. is disposed of.

Issue urgent certified copy as per rules.
