This matter is taken up through hybrid mode.

This petition has been filed by the Petitioner for transfer of C.M.C.(D.V.) No.125 of 2022 instituted at the instance of the Opposite Party-mother-in-law of the Petitioner, from the file of the learned S.D.J.M ., Bhubaneswar to the Court of the S.D.J.M., Jeypore on the ground that she being a widow lady having a child, it is not possible on her part to cover a far distance and contest the case.

Heard the learned counsel for the Petitioner. It goes without saying that the Opposite Party in this case is an old lady. The Petitioner is not required to remain

// 2 // present on each and every date of trial in the court at Bhubaneswar. The comparative inconvenience of the party, if the case is transferred to the court at Jeypore shall be much more than the inconvenience to be faced by the Petitioner, if the case is allowed to be continued at Bhubaneswar. Furthermore, it is also not the case of the Petitioner that the Opposite Party is neither staying at Bhubaneswar nor the cause of action had arisen at Bhubaneswar.

Considering the aforesaid facts and submissions made, this Court is, therefore, not inclined to allow the prayer made in this transfer petition.

Accordingly, the transfer petition stands dismissed. (S. Pujahari) Judge DA
