Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 38 of 2022 arising out of Kegaon P.S. Case No. 11 of 2022, pending on the file of the learned SDJM, Dharmagarh for the alleged commission of offence under Sections 328/343/363/366/376(2)(n)/506/34 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Dharamgarh by Order dtd.18.04.2022 in Bail Application No.13 of 2022, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

It is submitted that in the meanwhile Charge-sheet has been filed on 17.03.2022.

Considering the tenor of the 164 Cr.P.C. statement, medical examination report and other attending circumstances, this Court directs the petitioner to be released on bail. The terms to be fixed by the learned Court in seisin over the matter.

The BLAPL thus stands disposed of.
