This matter is taken up through Hybrid Mode.

Heard Mr. B. Chalan, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the Opposite Parties.

The petitioner is aggrieved by the process of selection relating to Anganwadi Worker at Nimma-II Anganwadi Centre in Borigaon Gram Panchayat under Boden Block, coming under the administrative control of the CDPO, Boden (Opposite Party No.4).

It is submitted by the learned counsel for the petitioner that, in terms of the revised Guidelines for selection of Anganwadi workers circulated by the Government in the Women and Child Department under letter dtd.02.05.2007 under the

heading Procedure in Clause-I, mechanism has been provided for redressal of complaints regarding selection of Anganwadi Workers , the same is quoted hereunder for convenience of ready reference;

"i. Sub-Collector will be the appellate authority for hearing complaints regarding selection of Anganwadi Workers for tribal and rural projects and Addl. District Magistrate will be the appellate authority for complaints regarding selection of Anganwadi Workers for urban projects. Collector shall be the appellate authority in case Sub-Collector/ADM have approved the selection as per para 'g' and 'h' above."

It is submitted that though, the petitioner has preferred a representation dtd. 06.04.2020, the same is yet to be considered by the Sub-Collector, who has been arrayed as Opposite Party No.3. 7.

Considering the nature of the grievance, the petitioner is permitted to file an appeal in terms of the guidelines quoted supra before the Opposite Party No.3 within a period of six weeks from today. On such appeal is being filed, the Opposite Party No.3 shall do well to dispose of the same within a further period of six weeks on merits after given opportunity of hearing to all concerned. 8.

Accordingly, the writ petition stands disposed of. 9.

Urgent certified copy of this order be granted as per rules.
