This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner.

The limited grievance of the Petitioner in the present writ petition is that DPC was held on 12.11.2021 to consider the case of 86 employees for promotion/up-gradation to the post of Dy. Manager (Elec.) in E-4 including the juniors of the Petitioner but the name of the Petitioner was not considered by the DPC. Being aggrieved by the said order of the DPC, although the Petitioner has submitted a representation before the CEO, TPWODL, Corporate Office, Burla, Opposite Party No.1 on 20.01.2022 (Annexure-12), however, the said representation is still pending before the said Opposite Party No.1 as of now.

Considering the limited grievance of the Petitioner, this Court disposes of the writ petition with a direction to the CEO, TPWODL, Corporate Office, Burla, Opposite Party No.1 to consider

// 2 // the representation of the Petitioner dated 20.01.2022 in accordance with law keeping in view the Regulation 16 of Western Electricity Supply Company Officers Service Regulations, 1998 within a period of two months from the date of production of certified copy by passing a speaking and reasoned order. Further, Opposite Party No.1 is directed to do well to dispose of the same in the light of the promotion/up-gradation given to the juniors of the Petitioner. Any decision taken on the same shall be communicated to the Petitioner within a period of two weeks thereafter.

Further, it is directed that while considering the representation of the Petitioner, the authorities shall keep in mind the promotion/up-gradation made under Annexure-8 series, copy of which shall be provided to the Opposite Parties along with copy of this order.

With the above direction, the Writ Petition stands disposed of.

Issue urgent certified copy as per rules.
