None appears for the Petitioner at the time of call. 3.

The IA has been filed for condonation of delay in filing the RPFAM. SR has pointed out delay of 340 days in filing the RPFAM.

On perusal of record, it appears that since the date of filing, i.e., 21st May, 2010 no step has been taken to get the matter listed. The order impugned in the RPFAM was passed by learned Judge, Family Court, Cuttack on 9th March, 2009 in Cr.P. No.236 of 2007.

From the above, it appears that the Petitioner has lost interest in pursuing the RPFAM. Accordingly, the IA as well as the RPFAM stand dismissed for non-prosecution. (K.R. Mohapatra) Judge s.s.satapathy
