I.A. No.1215 of 2022 02.

1. This is an application for modification of the order dated 18.5.2022 passed in CRLMC No.1177 of 2022.

2. Heard Ms. S. Behera on behalf of Mr. H.N. Mohapatra, learned counsel for the Petitioner and Mrs. S. Pattanaik, learned Additional Government Advocate for the State-Opposite Party.

3. Upon hearing learned counsel for the Petitioner, the order dated 18.5.2022 of this Court is modified to the extent below.

4. In place of paragraph 2 of the said order, the following paragraph be substituted.

"2. It is submitted on behalf of the Petitioner that he was released on bail on 19.12.2018 in C.T. Case No.277 of 2017 pending on the file of learned J.M.F.C., Athagarh for alleged commission of offences under Sections 498-A/506/507/34 of the I.P.C. and Section 4 of the D.P. Act and subsequently due to his non-appearance before the court below, for

the reason of communication gap with his lawyer, NBW of arrest was issued against him on 23.10.2021."

5. Accordingly, the date of surrender of the Petitioner is extended till 8th August, 2022 and the date mentioned in paragraph 3 of the order dated 18.5.2022 is modified as '8th August, 2022'.

6. The rest part of the order dated 18.5.2022 remains unaltered.

7. The I.A. is disposed of.

8. An urgent certified copy of this order be granted on proper application.
