This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to set aside the judgment and order of maintenance dated 16th May, 2005 passed by the learned Sessions Judge, Phulbani in Crl. Rev. Petition No.21 of 2000 upholding the judgment and order of maintenance dated 2nd March, 2000 passed by the learned S.D.J.M., Phulbani in M.C. No.53 of 1998.

Learned counsel for the Petitioner submits that he has no instruction in the matter from her client.

Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2010 where no interim order was passed, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter. 5.
Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
