BLAPL No.3837 of 2022 Sudar @ Sudarsan Nayak ....

Petitioner Mr. Niranjan Panda, Advocate -Versus - State of Odisha ....

Opposite Party Mr. S.K.Mishra, Additional Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA ORDER_ 22.09.2022 1.

This matter is taken up through hybrid mode.

Order No.

4.

2.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

3.

The petitioner is in custody since 17.04.2022 in connection with Khandapada P.S. Case No. 84 of 2022 corresponding to G.R. Case No. 81 of 2022 pending in the court of learned J.M.F.C., Khandapada for the alleged commission of offence under Sections 294/323/324/341/307/354/379/452/506/34 of IPC. 4.

It is alleged that the petitioner assaulted the victim by means of deadly weapons causing injuries on his person. It is submitted that the matter has arisen out of the recently concluded Panchayat election between two groups in course of a free-fight. 5.

Considering the fact that charge sheet has already been submitted as also taking account the period of detention in custody, I am inclined to allow the prayer for bail. Let the

petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the following conditions:

(i) The petitioner shall not approach, threaten, coerce or pressurize the informant or his family members in any manner whatsoever.

(ii) He shall appear before the IIC of Khandapada police station on every Sunday at 10.00 a.m. for a period of six months.

(iii) He shall personal personally appear before the court in seisin over the matter on each date of posting of the case and in case of even a single default necessary orders shall be passed by the Court to take him into custody.

6. The BLAPL is accordingly disposed of.

7. Urgent certified copy of this order be granted on proper application.
