This matter is taken up through Hybrid mode.

The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 28.02.2012 passed by the learned S.D.J.M., Berhampur in 1.C.C. No.242 of 2010 taking cognizance of the offences under Sections 420 and 406 of IPC.

Heard the learned counsel for the petitioner and the learned counsel for the State.

Considering the facts and circumstances of this case, this Court is not inclined to interfere with the impugned order of cognizance. Hence, this CRLMC filed challenging the

// 2 // impugned order of cognizance being devoid of any merit stands dismissed. Interim order dated 08.08.2012 passed by this Court stands vacated.

However, liberty is given to the petitioner to raise all such contentions at the time of framing of charge, if the charge has not been framed in the meanwhile.

A copy of this order be communicated to the Court below forthwith.
