1. None appears on behalf of the Petitioner to pursue the matter. Order No.

2. Vide order dated 26th August,2022 and 02nd September,2022 on the request of the learned counsel, the matter was adjourned.

3. By means of this petition, the Petitioner seeks to set aside the impugned Order dated 08th July,2015 passed by the learned Assistant Sessions Judge, Kantabanji in connection with S.C.Case No.75/87/153 of 2009-13. It reveals from the case record that charge sheet has already been submitted in the case under section 376 (2)(f) of the I.P.C.

4. Learned counsel for the State submits that there is sufficient material to presume as also reveals from the statement of the victim recorded under section 164 Cr.P.C besides her earlier statement.

5. It seems the petitioner too does not want to pursue the matter.

6. The interim order has been passed since 2016.

7. Having regard to the materials, since the offence is made out against the Petitioner under section 376(2)(f) I.P.C, this court is not inclined to interfere with the impugned order.

8. The CRLMC is dismissed.
