This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No. 38 of 2021 corresponding to Baramba P.S. Case No. 38 of 2021, pending on the file of the learned J.M.F.C., Baramba for the alleged commission of offence under Sections-448/376(2)(m) of the I.P.C. and the petitioner is in custody since 26.02.2021.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Athagarh by Order dtd. 18.03.2021 in BLAPL No. 61 of 2021, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

On perusal of the statement recorded under Section-164 Cr.P.C. as well as the Medical Examination Report of the victim, taking into account the period of detention since 26.02.2021, this Court directs the petitioner to be released on bail in connection with G.R. Case No. 38 of 2021 corresponding to Baramba P.S. Case No. 38 of 2021, pending on the file of the learned J.M.F.C., Baramba, on such terms to be fixed by the Court in seisin of the matter.

The BLAPL thus stands disposed of.
