This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Learned counsel for the Petitioner is permitted to carry out necessary correction in the writ petition in Court today. 3.
Heard learned counsel for the Petitioner and learned counsel for the State.

The present writ petition has been filed with the following relief:
"Under the facts and circumstances as narrated above, this Hon'ble Court may graciously be pleased to issue notice to the Opp. Parties and after hearing the parties be pleased to direct the Opp. Parties to promote the Petitioner to the post of Senior Clerk/Senior Assistant along with all the consequential service benefits as expeditiously as possible and pass such other order/orders as this Hon'ble Court deems just and proper.
// 2 // And for this act of kindness, the humble petitioner as in duty bound shall ever pray."

It is submitted by learned counsel for the Petitioner that by letter No.3740/DWO Dt.27.11.2020, the representation of the Petitioner under Annexure-3 has already been forwarded by the District Welfare Officer, Mayurbhanj-Opposite Party No.3 to the Principal Secretary to Govt. ST & SC Development Department, Minorities & Backward Classes Welfare Department, Bhubaneswar, Opposite Party No.1 for consideration. It is submitted by learned counsel for the Petitioner that although the Petitioner has filed representation dated 10.11.2020 under Annexure-3 before the Opposite Party No.1, but no decision has been taken on the same as of now. It is further submitted the Petitioner has filed another representation dated 01.10.2021 (Annexure-5 series) before the Opposite Party No.1, the same is pending for consideration before the Authority.

Leaned counsel for the State submits that he has no objection if a direction is given to the Authorities to consider the grievance petition of the Petitioner in accordance with law within a stipulated period of time.

Considering the submissions made by the respective parties, the limited nature of grievance involved in the present writ petition, keeping in view the case of the Petitioner, this Court disposes of the writ petition at the stage of admission with a direction to the Principal Secretary to Govt. ST & SC Development Department, Minorities & Backward Classes Welfare Department, Bhubaneswar, Opposite Party No.1 to consider the representation of the Petitioner
// 3 // dated 01.10.2021 (Annexure-5 series) in accordance with law within a period of two months from the date of production of certified copy of this order. It is needless to mention here that the representation of the Petitioner under Annexure-5 series shall be considered and disposed of by passing a speaking and reasoned order. Any decision taken on the same shall be communicated to the Petitioner within a period of ten days thereafter.

With the above direction, the Writ Petition stands disposed of.

Issue urgent certified copy as per rules.
