05.05.2022 ABLAPL No.5182 of 2022 & I.A. No.506 of 2022 02.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This interim application has been filed for seeking interim protection on the ground of marriage ceremony of the niece of the petitioner which is going to be solemnized on 09.05.2022. The marriage invitation card has been annexed to the interim application.

Learned counsel for the State has produced the instruction dated 04.05.2022 received from the Inspector incharge of Cyber Crime and Economic Offences, P.S., Sambalpur which indicates that the petitioner has booked a hall for marriage of his relative. However, it is mentioned that

// 2 // the poor people and daily wages laborers are fallen prey to the criminal conspiracy of cheating. The written instruction is taken on record.

Considering the submissions made by the learned counsel for the respective parties, the grounds taken in the interim application, it is directed that the petitioner shall not be arrested in connection with Cyber P.S. Sambalpur Case No.24 of 2022 corresponding to G.R. Case No.1645 of 2022 pending in the Court of learned S.D.J.M., Sambalpur from 06.05.2022 till 10.05.2022 and thereafter the petitioner shall surrender in the Court below and move for bail within a period of four weeks from 11.05.2022, in the event of which the learned Courts below shall dispose of the same in accordance with law. The case records shall be made available to the Court concerned for disposal of the bail application. Accordingly, both the I.A. and ABLAPL are disposed of. Issue urgent certified copy as per Rules.

A free copy of this order be handed over to the learned counsel for the State.
