Mohanty, learned Additional Government Advocate states that he has received instructions, vide letter dated 26.01.2022 from the Tahasildar, Odapada, wherein it has been stated as follows:- ".... as per directions passed by Hon'ble High Court in W.P.(C) No. 11669/2021, Collector, Dhenkanal has been pleased to allow and settle the Source in favour of the petitioner-Sri Trupari Sahoo the 2nd highest bidder of the 1st Tender held on dated 03.02.2021 with a Additional charge @ 373/- per cubic meter.

Accordingly Sri Tripurari Sahoo has deposited the required Govt. dues on 25.05.2021 and lease deed was made with Sri Tripurari Sahoo on 04.06.2021 and work order was issued on dated 09.07.2021 after obtaining Consent to Operate (CTO) from Regional Officer, State Pollution Control Board, Angul by the

Lessee Sri Sahoo. Since then Sri Sahoo is operating the Source."

In view of the above, since in favour of Trupari Sahoo quarry lease has already been settled and he is operating the source, by efflux of time, the writ petition has become infructuous.

Accordingly, the writ petition stands disposed of as infructuous.
