This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with T.R. Case No. 21 of 2021 corresponding to EI & EB Unit-II, Cuttack Case No. 05 of 2021, pending on the file of the learned 1st Additional Sessions Judge, Khurda, for the alleged commission of offence under Sections-20(c) of the N.D.P.S. Act and the petitioner is in custody since 06.04.2021. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned 1st Additional Sessions Judge, Khurda by Order dtd. 08.04.2021 in T.R. No. 21 of 2021, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

In view of the quantity of contraband, i.e., Brown Sugar stated to have been recovered from the conscious possession of the petitioner, this Court is not inclined to entertain the bail application under Section 439 Cr.P.C.

It is stated by the learned counsel for the petitioner that in the meanwhile trial has been commenced and witnesses have already been examined.

Since the petitioner is a young man of 22 years old and he is in custody since 06.04.2021, the learned Court in seisin of the matter shall make all endeavour to conclude the trial as expeditiously as possible.

With such observation, the BLAPL stands disposed of. 9.
