This matter is taken up through hybrid arrangement (virtual/physical mode).

This is the second journey of the petitioner, who is in custody in connection with Damanjodi P.S. Case No.50 of 2020 corresponding to T.R. Case No.35 of 2020 pending in the court of the learned Additional Sessions Judge-cum-Special Judge, Koraput running for the alleged commission of offence under sections 20(b)(ii)(C)/25 of the N.D.P.S. Act in filing this application under section 439, Cr.P.C. for his release on bail. 3.

Heard learned counsel for the petitioner and learned counsel for the State.

Taking into account the submissions made; further keeping in view the materials on records as those stand against the Petitioner with other surrounding circumstances including the factum of release of coaccused person on bail and as also the period of detention of the Petitioner in custody; it is directed that the petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just

// 2 // and proper by the court in seisin of the case with further conditions that:- (i) he will appear in person on each date of posting of the case before the court in seisin of the case without fail; (ii) will report before the Officer-in-Charge of the Barahara police station, village.-Neknamtola, Dist- Bhojpur, State of Bihar on last Monday of every month without fail till conclusion of trial; and (iii) will give his contact address and cell phone numbers by furnishing affidavit and in case of change shall so intimate by further affidavit before the court in seisin of the case. 5.

The BLAPL is accordingly disposed of.
