This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State. Perused the record as well as documents annexed to the writ petition.

The present writ petition has been filed by the petitioner with a prayer for a direction to sanction and disburse the arrear dues, which is due and admissible in favour of the petitioner. 4.

It is submitted by learned counsel for the petitioner that the petitioner has retired from his service in the meantime on attaining the age of superannuation and after his retirement he is facing difficulties and is not getting financial benefits as of now. 5.

Learned counsel for the State referring to the order passed by the Collector, Nayagarh-Opposite Party No.2 submits that some dues has already been paid and outstanding some are being processed by the Opposite Party No.2. In such view of the matter, learned counsel for the State submits that let the petitioner be approached to the said Opposite Party No.3 by filing a detail particular outstanding dues and

// 2 // file a afresh representation. Such a representation is filed by the petitioner, Opposite Party No.2 may be directed to dispose of the same within a stipulated period of time.

Considering the submissions made, this Court deems it proper to dispose of the writ petition by directing the petitioner to file a fresh representation highlighting his grievances along with copies of the relevant documents in support of his claim and a certified copy of this order before the Collector, Nayagarh-Opposite Party No.2 within a period of two weeks from today. In the event such a representation is filed within the aforesaid period, the Opposite Party No.2 shall do well to consider and dispose of the same within a period of four weeks from the date of receipt of the representation and the same shall be considered and disposed of by passing a speaking and reasoned order within the aforesaid time stipulated. It is further made clear that in the event the petitioner is entitled to get the arrear outstanding, the same shall be sanctioned and disbursed in favour of the petitioner thereafter. Any decision taken on the same shall be communicated to the Petitioner within a period of two week thereafter.

With the aforesaid observation/direction, the writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
