None appears for the petitioners at the time of call. A bare perusal of record would go to indicate that the defect as pointed out has not yet been removed even after more than six years of filing of this present CRLMC. Therefore, this Court reasonably entertains a doubt as to whether the cause of action still survives for the petitioner.

It, therefore, presupposes that the petitioners are not interested to prosecute the matter.

Hence, the CRLMC is dismissed.
