This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for State.

The petitioner is an accused in S.T. Case No.101 of 2021 arising out of Baghamari P.S. Case No.55(12) of 2020 & G.R. Case No.623 of 2020, pending in the Court of learned S.D.J.M., Khurda, under Sections 458/395 of IPC, Section 25 of Arms Act and Section 3 & 4 of Explosive Substance Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned CJM-cum-ASJ, Khurda, by order dated 21.04.2022 in the aforementioned case, the present BLAPL has been filed.

This Court be order dated 05.04.2022 has permitted the bail application to be withdrawn with liberty to move this Court at later stage after examination of material witnesses.

Since there is no change of circumstance and Keeping in view the criminal proclivity of the petitioner in as much as it is on record that the petitioner has eleven criminal antecedents, this Court is not inclined to entertain this bail application at this stage. 7.

Accordingly the BLAPL stands rejected.
