This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with C.T. Case No. 18 of 2021, arising out of Athagarh P.S. Case No. 10 of 2021 pending in the Court of learned S.D.J.M., Athagarh for the alleged commission of offence punishable under Sections-452/294/323/324/427/354/379/506/34 of the I.P.C. 4.

Learned counsel for the petitioners submits that this Court by order dtd.25.02.2021 in ABLAPL No. 1202 of 2021 has granted anticipatory bail to the petitioner. In the meantime,

charge-sheet has been filed on 19.04.2021 wherein the petitioner has been found to be involved in a higher offence. 5.

Learned Counsel for the State submits that the allegation of Section-307 of the I.P.C is primarily against Petitioner No.1Pabitra Burma. 6.

Taking into account the nature of allegation, this Court had directed release of the petitioner on anticipatory bail and there is no allegation of violation of any of the conditions imposed by this Court.

In the factual matrix of the case, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioners shall be released on bail.

The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper. 9.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
