This application under Section 482 of Cr.P.C. has been filed by the Petitioner challenging the order of cognizance dated 9th July, 2009 passed by the learned S.D.J.M., Balasore in 1.C.C. No.678 of 2008.

It appears that in this case notice has not yet been issued though the case was filed in the year 2012. The present status is also not known by the learned counsel for the Petitioner. 4.

As such, the Criminal Misc. Case stands dismissed. 5.

However, liberty is given to the Petitioner to move before this Court by filing a fresh petition, if the case is still pending. (S. Pujahari) Judge DA
