This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner has filed this writ petition seeking direction to the Opposite Parties to modify the grade pay to Rs.5400/- instead of Rs.4800/- at the stage of 3rd financial upgradation with effect from 01.01.2013 in favour of the Petitioner as has been sanctioned in favour of similarly employee under Annexure-5 with all consequential benefits within a stipulate period of time. 4.
Mr. M. Pati, learned counsel for the Petitioner contended that similar matter had come up for consideration before the Tribunal in O.A. No.1506 of 2019 (Rabindranath Sahu vs. State of Odisha and others), wherein such benefit has been extended to the Petitioner in the said original application under Annexure-5. It is contended that since the Petitioner stands in the same footing, the benefit should have been extended in favour of the Petitioner.

Considering the contention raised by learned counsel for the Petitioner and after going through the records, this writ petition stands disposed of directing Opposite Party No.3 to consider the representation of the Petitioner in the light of the order passed by the Tribunal in O.A. No.1506 of 2019 (Rabindranath Sahu vs. State of Odisha and others) and taking into consideration Annexure-5, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order. 6.
With the above direction, the Writ Petition stands disposed of.
