Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to opposite party no.3 to give him appointment order under Rehabilitation Assistance Scheme, as per provisions of Odisha Civil Service (Rehabilitation Assistance) Amendment Rules, 2016 being the appointing authority.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made legal notice/representation to opposite party no.3, vide Annexure-4 series and the same may be directed to be considered and disposed of taking into consideration the judgment of the apex Court in Malaya Nanda Sethy v. State of Orissa, Civil Appeal No. 4103 of 2022 disposed of on 20.05.2022 within a stipulated time, to which learned State Counsel has raised no objection.

As agreed to by learned counsel for the parties, this

Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.3 to consider the legal notice/representation filed by the petitioner vide Annexure-4 series and pass appropriate order in accordance with law taking into consideration the judgment of the apex Court in Malaya Nanda Sethy (supra) within a period of three months from the date of production of certified copy this order.
