This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T. Case No. 08 of 2021 arising out of Daringbadi P.S. Case No. 19 of 2021, pending on the file of the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Phulbani for the alleged commission of offence under Sections451/376(2)(n)/376(1)/385/109/506/34 of the IPC read with Section-4 of the POCSO Act. The petitioner is in custody since 04.03.2021.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. District & Sessions Judge-cum-Special Court under POCSO Act, Phulbani by Order dtd. 17.03.2021 in C.T. Case No. 08 of 2021, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Perused the 164 Cr.P.C. statement of the victim. 6.

Considering that the Charge-sheet in the case has been filed in the meanwhile and the tenor of the 164 Cr.P.C. statement and the period of custody, this Court directs the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 8.
