This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the proceeding under Section 107 of Cr.P.C., i.e., CMC No.817 of 2010, arising out of Chandrasekharpur P.S. No.31 of 2010, pending in the Court of Additional D.C.P.-cum-Executive Magistrate, Bhubaneswar.

Learned counsel for the Petitioner submits that he has no instruction in the matter from his clients.

Considering the submission of the learned counsel for the Petitioners and the fact that the case is the year 2010 where no interim order was passed, this Court is of the view that the Petitioners are recalcitrant litigants and do not want to proceed with the matter. 5.

Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
