1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard Mr. Abhiram Patra, learned counsel for the Appellant. Even though matter was filed in the year 2010 seeking enhancement of the compensation, but the matter was never listed at the instance of the Appellant. Even no notice has been issued of limitation. This Court after going through the grounds on the question finds that there is no convincing ground to condone the delay.

3. Accordingly, the misc. Case is rejected. Consequentially, the appeal also fails and dismissed.
