Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 02.04.2021 in connection with Tangarpalli P.S. Case No.227 of 2020 corresponding to S.T. Case No.58 of 2021 pending in the Court of 1ST Addl. District and Sessions Judge, Rourkela for the alleged commission of offence under Sections 302/201/34 of IPC.

Considering the submissions and the fact that one of the eye-witnesses, namely, July Hansda, who has been examined as P.W.-1 in the ongoing trial, has not supported the case of the prosecution coupled with the fact that similarly placed coaccused, namely, Golu @ Balaram Lohar has been granted bail as per order passed by this Court in BLAPL No. 3163 of 2022, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the
trial Court on each date of posting of the case without fail. 5.
BLAPL is accordingly disposed of.
