This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 663 of 2022, arising out of Sambalpur Town P.S. Case No. 57 of 2022 pending in the Court of learned SDJM, Sambalpur for the alleged commission of offence punishable under Sections 419/420/465/467/468/471/34 of the I.P.C. 4.

Learned counsel for the Petitioner has placed on record the copy of the final form by way of charge sheet dated 17.04.2022 wherein the Petitioner has been shown as one of the accused persons. It is submitted by the learned counsel for the

Petitioner that he was initially not named in the FIR but has been mechanically implicated as an accused in the final form. 5.

Taking into account the nature of the allegations which are prima facie based on documents and admittedly the investigation having been concluded, this Court is of the considered opinion that no useful purpose will be served by custodial interrogation and accordingly it is directed that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

It is submitted by the learned Counsel for the petitioner that the petitioner has no criminal proclivity. While enlarging the petitioner on bail, the learned Court below shall verify such assertion. If it comes to the fore that the petitioner has any criminal antecedents, this order shall stand recalled automatically without any further reference to this Court.

The copy of the charge sheet filed by the learned counsel for the Petitioner is taken on record.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
