This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with S.T. Case No. 16 of 2021 arising out of Lalbag P.S. Case No.198 of 2019 pending in the Court of learned 3rd Addl. Sessions Judge, Cuttack for alleged commission of offences punishable under section 302 of the Indian Penal Code.
After going through the evidence of the witnesses recorded during trial and since the petitioner's name find place in the dying declaration and in view of the nature and the gravity of accusation against the petitioner, while not inclining to release
// 2 // the petitioner on bail, but taking into account the period of detention of the petitioner in judicial custody, I direct the learned trial Court to expedite the trial and make every endeavour to conclude the same by the end of December 2022.
BLAPL is accordingly disposed of.
