This RPFAM has been filed assailing the order dated 17th September, 2008 (Annexure-1) passed by learned Judge, Family Court, Rourkela in Criminal Proceeding No.12 of 2008, whereby the Petitioner has been directed to pay maintenance @ Rs.1,000/- per month to Opposite Party No.1 and Rs.500/- per month to Opposite Party No.2 from the date of filing of the application.

Mr. Satpathy, learned counsel appearing on behalf of Mr. Nayak, learned counsel for the Petitioner submits that he has no instruction in the matter.

Accordingly, the RPFAM is dismissed for nonprosecution. 5.

Interim order dated 7th January, 2011 passed in Misc. Case No.93 of 2010 stands vacated.
