This matter is taken up through Hybrid Mode.

2.

There is no appearance on behalf of the informant/victim when the matter is called.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.948 of 2020 arising out of Balipatna P.S. Case No. 359 of 2020 pending on the file of learned JMFC(O), Bhubaneswar, registered for the alleged commission of offence under sections 376(2)(n)/506 of the I.P.C.

Being aggrieved by the rejection of his application for bail under Section. 439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Bhubaneswar by order dated 03.02.2021, the present BLAPL has been filed.

Learned counsel for the State on instruction submits that in the meantime during the period when the petitioner was released on interim bail, the victim has got married to the petitioner.

Taking note of such submission, this Court directs that the petitioner to be released on bail. Learned court in seisin over the matter shall fix the terms.

7.

Accordingly, the BLAPL stands disposed of.
