Petitioner Mr.B.N. Mohanty, Advocate Vs.

Registrar, Central Administrative Tribunal, Cuttack Bench, Cuttack & Ors.

.....

Opposite parties Mr. P.K. Parhi, ASGI

CORAM:

DR. JUSTICE B.R. SARANGI MISS JUSTICE SAVITRI RATHO

ORDER

16.05.2022 Order No.

This matter is taken up through hybrid mode.

2. Heard Mr. B.N. Mohanty, learned counsel for the petitioner and Mr. P.K. Parhi, learned Assistant Solicitor General of India.

3.

The petitioner has filed this writ petition challenging the order dated 14.12.2021 under Annexure-2 passed in M.A. No.577 of 2021 (arising out of O.A. No.76 of 2021), by which the Central Administrative Tribunal, Cuttack Bench, Cuttack, while declining to grant any interim order, in view of earlier orders dated 19.03.2021 and 21.04.2021, directed that since the case is ready for hearing and is likely to be disposed of on merit, let the same be posted on 24.12.2021 for final hearing along with other M.As. In the meantime, five months have passed. More so, the petitioner has filed this writ petition without annexing the copy of the orders dated 19.03.2021 and

21.04.2021, basing upon which the M.A. No.578 of 2021 has been disposed of.

4.

In view of such position, learned counsel for the petitioner states that the petitioner may be permitted to withdraw the writ petition with liberty to file a fresh writ petition with better particulars.

5.

In view of the above, the writ petition stands disposed of granting liberty as aforesaid.
