Mrs. S. Mohanty, learned counsel for the Appellant submits that the Appellant has taken away the brief from their office since long and thus they have no further instruction in pursuing this appeal.

The record reveals that as yet no advocate has appeared on behalf of the Appellant by filing Vakalatnama. None also appears on behalf of the Appellant when called in this Appeal of the year 2004 which is lying on board without being admitted.

In the above state of affair, the Appeal stands dismissed for non-prosecution.
